Booking Terms and Conditions
1.
General
The following terms and conditions apply to all clients
wishing to utilise the services of PageSix Transcription
Services. Please ensure that you read and agree to adhere
to the following terms and conditions prior to completing
our online booking form. By completing our online booking
form it is accepted that you agree to be bound by these
terms and conditions in their entirety.
2.
Authorisation
By completing our online booking form you acknowledge your
authorisation to make such a booking on behalf of the organisation
or company which you represent. Please ensure that you provide
PageSix Transcription Services will any relevant purchase
order numbers or project codes at the time of completing
our online booking form under the “special instructions”
field.
3.
Accuracy
Every effort will be made to transcribe all client audio
recording professionally and accurately. PageSix Transcription
Services use experienced, UK based transcribers and all
work produced is subject to a robust quality control process
to ensure that we provide the best possible service for
our clients. You accept that the quality of the final transcription
produced will be dependent on the quality of the audio recording(s)
that you provide. You accept that factors such as background
noise, interference, over speaking and poor acoustics may
at times prevent our being able to accurately transcribe
your recording(s) and the completed transcript may therefore
contain inaudibles and mistranslates. To assist us in producing
the most accurate transcription possible please ensure that
you provide us with the follow information if available:
A list of all speakers names, a glossary of any unusual
terms and phrases which will be referred to during the recording
and any preparatory information which may assist us in providing
this service.
4.
Turnaround
PageSix Transcription Services will strive to deliver your
completed transcript within the turnaround time selected
by you on our booking form. In the extremely unlikely event
that we are unable to send you the completed transcription
on time we shall contact you in advance to discuss your
booking. It is very rare that we are unable to meet client
turnaround requirements however factors such as poor quality
audio and the absence of information such as speaker names
and glossaries may lead to such a delay.
5. Confidentiality
PageSix Transcription Services will treat all client information
as strictly confidential and shall never disclose any information
to a third party unless we have a legal obligation to do
so. All of our transcribers are based in the UK and are
required to fully adhere to our confidentiality and non-disclosure
policy. Your audio files and transcripts are encrypted during
transfer through our audio upload system. Your audio files
and transcripts will be safely destroyed within 30 days
of your invoice being settled. You may track the progress
of your transcription order and we provide password protected
accounts for clients - no one will know your password but
you.
6. Payment terms
Our credit terms are 14 days from the date of invoice (unless
otherwise agreed in writing). Please be aware that PageSix
Transcription Services reserve the right to apply Statutory
Late Payment Interest and late fees to any overdue balance
that remains outstanding once our credit terms have expired.
Such action would be taken in accordance with The Late Payment
of Commercial Debts (Interest) Act 1998.
7.
Copyright
By completing the booking form you warrant that you have
the rights to use the audio recordings provided and you
will indemnify PageSix Transcription Services against any
claims or actions for loss or damage arising from any future
copyright infringement relating to the audio recordings
that you provide. PageSix Transcription Services acknowledge
that we have no rights to the copyright of any transcripts
produced for our clients.
8.
Limitation of liability
In the event that any legal action or claim is brought against
PageSix Transcription Services, including negligence and
breach of statutory duty, then you agree that the maximum
extent of PageSix Transcription Services’ liability
will be limited to an amount equal to twice the quoted value
of the transcription order placed by you. This clause shall
not act or be interpreted so as to act to exclude or limit
our liability for death or personal injury of any person
resulting from our negligence.
9.
Miscellaneous
Should any term or any part of any term included within
these Terms and Conditions is held by English law to be
invalid, unlawful or unenforceable, it shall not affect
the enforceability of any of the remaining Terms and Conditions.
These Terms constitute the entire agreement between you
and us with respect to the subject matter hereof and may
not be varied without our written consent.
10.
Legal Jurisdiction
These terms shall be governed and construed in accordance
with English law and are subject to the exclusive jurisdiction
of the English courts.
